 AGREEMENT TO TERMS

These Terms & Conditions (“Legal Terms”) constitute a legally binding agreement between you (“you” or “user”) and Air Con Truck Parts (“Company”), a Texas-based business, regarding your access to and use of https://www.aircontruckparts.com and related services (collectively, the “Services”).

By accessing or using the Services, or by clicking “I agree” where presented, you acknowledge that you have read, understood, and agree to be bound by these Legal Terms.

If you do not agree, you must not use the Services.

SERVICES OVERVIEW

Air Con Truck Parts provides heavy-duty truck, bus, and off-road equipment parts, including compressors, condensers, evaporators, fittings, hoses, and tools.

You may not use the Services in any jurisdiction where such use would violate applicable law or require additional licensing or registration by the Company.

Users accessing the Services from outside the United States are responsible for compliance with applicable local laws.

While the Services may follow certain industry best practices, they are not intended for use with data or activities regulated by HIPAA, FISMA, GLBA, or similar laws. You agree not to use the Services in a way that would subject the Company to those requirements.


INTELLECTUAL PROPERTY RIGHTS

All content, trademarks, service marks, designs, software, code, data, and other materials made available through the Services (“Content”) are owned by or licensed to the Company and are protected by applicable intellectual property and other laws.

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services and Content, including to download and use PDF materials made available through the Services, solely for your internal, lawful purposes.

Except as expressly permitted in these Terms, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, transmit, reverse engineer, decompile, disassemble, or otherwise exploit any Content or the Services without the Company’s prior written consent, except to the extent such restriction is prohibited by applicable law.

All rights not expressly granted to you are reserved by the Company and its licensors.


USER COMMITMENTS

By using the Services, you represent and agree that:

  • All information provided is accurate and complete
  • You are at least 18 years old
  • You will comply with all applicable laws
  • You will not use automated tools (bots, scraping tools, scripts, their next generation versions, etc.) without written authorization

ACCOUNT SETUP

Certain features may require account registration

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity occurring under your account

You agree to notify us immediately of any unauthorized use.

We reserve the right to suspend, terminate, or modify accounts at our sole discretion.


PRODUCT INFORMATION

We attempt to ensure that product descriptions and specifications are accurate: however, we do not guarantee their accuracy, completeness, or availability.

Products may

  • Be modified or discontinued at any time
  • Contain errors or inaccuracies
  • Be corrected after an order is placed

Product Use Disclaimer:

You are solely responsible for ensuring compatibility and proper installation. Products must be installed and used by qualified professionals. The Company is not liable for damage, failure, or injury resulting from improper use or installation.


ORDERS & PAYMENTS

All payments are processed by third-party services such as Stripe.

The Company:

  • Is not a payment processor
  • Disclaims liability for third-party payment failures or errors

Orders are accepted only upon shipment confirmation. We reserve the right to refuse, limit, or cancel any order at our discretion.

Prices:

  • Are subject to change prior to order acceptance
  • May be corrected at any time, including after submission

SHIPPING, DELIVERY & RISK OF LOSS

Shipping and delivery dates are estimates only and are not guaranteed.

We are not responsible for delays caused by carriers, supply chain disruptions, weather, wars or international conflicts, pandemics, or events beyond our control.

Title transfers to you upon delivery of products to the carrier.

The Company is not responsible for:

  • Shipping delays
  • Carrier errors
  • Lost, stolen, or damaged shipments after transfer

You are responsible for filing claims with the shipping carrier.


RETURNS & WARRANTY POLICY

All returns and warranties are governed exclusively by our Return & Warranty Policy, which is incorporated into these Terms by reference.


PROHIBITED ACTIVITIES

You may not:

  • Violate any applicable law
  • Interfere with the security or functionality of the Services
  • Reverse engineer or attempt to access source code
  • Upload malicious code or harmful content
  • Use the Services for unauthorized commercial purposes

USER CONTRIBUTIONS

User contributions must:

  • Not infringe any third-party rights
  • Not be unlawful or offensive
  • Not contain viruses or malicious code

CONTRIBUTION LICENSE

You retain ownership of your contributions but grant the Company a perpetual, irrevocable, worldwide, royalty-free, and sublicensable license to use them.


THIRD-PARTY SERVICES

We disclaim all responsibility and liability for third-party websites, content, and transactions.


SERVICE MANGEMENT

We may monitor, restrict, suspend, or remove content or access at any time and take any action necessary to protect the Services or enforce these Terms.


PRIVACY POLICY

Your use of the Services constitutes acknowledgment of an agreement to our Privacy Policy.


TERMINATION

We may suspend or terminate your access immediately, without notice, for any reason.


MODIFICATIONS AND INTERRUPTIONS

We may modify or discontinue the Services at any time and are not liable for any resulting interruptions or losses.

DISCLAIMERS

The Services are provided “AS IS” and ‘AS AVAILABLE”

To the fullest extent permitted by law, we disclaim all warranties, express or implied.


LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW:

Air Con Truck Parts shall not be liable for any indirect, incidental, consequential, or punitive damages.

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.


INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Air Con Truck Parts from any claims, damages, or expenses, including Air Con’s attorney’s fees, arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your infringement of any third-party rights

This obligation to indemnify Air Con survives termination of your use of the Services and/or termination of your business relationship with Air Con.


DISPUTE RESOLUTION & ARBITRATION

Before filing a claim, you agree to attempt informal resolution by contacting us.

If unresolved, disputes shall be resolved through binding arbitration in Dallas, Texas, under the applicable arbitration rules of the American Arbitration Association.

You agree to:

  • Waive the right to a jury trial
  • Waive participation in class actions

GOVERNING LAW

These Terms are governed by the laws of the State of Texas. You agree to the jurisdiction of courts located in Dallas County, Texas.


JURY TRIAL WAIVER:

You and the Company waive any right to a jury trial.


CORRECTIONS

We reserve the right to correct errors, inaccuracies, or omissions at any time, including after an order has been placed.


DATA HANDLING

You are responsible for your data.

To the fullest extent permitted by the law, we disclaim liability for data loss or corruption.


ELECTRONIC AGREEMENT

You agree that electronic communications and signatures satisfy all legal requirements for written agreements.


CALIFORNIA CONSUMER RIGHTS NOTICE

Warranty Rights:
If you are a California resident, certain products purchased from Air Con Truck Parts are subject to the Song-Beverly Consumer Warranty Act (Cal. Civ. Code §§ 1790 et seq.). Under this law, you may request a repair, replacement, or refund for any product that is defective or fails to conform to its express warranty. These rights are in addition to, and do not limit, any rights provided under Air Con Truck Parts’ standard Return & Warranty Policy.

FORCE MAJEURE

The Company is not liable for delays or failure to perform due to events beyond its reasonable control, including weather, natural disasters, supply chain disruptions, labor disputes, wars or international conflicts, pandemics, or government actions.


MISCELLANEOUS

These Terms constitute the entire agreement. If any provision is deemed invalid, the remaining provisions remain in full force.

Standard carrier charges may apply.
